PUBLIC OFFER for the conclusion of a contract for the sale of goods by remote means

1. GENERAL PROVISIONS
1.1 This document is a public offer (hereinafter – the “Offer”) in accordance with Article 437 of the Civil Code of the Russian Federation and contains all material terms and conditions of the distance selling contract.
1.2 The Offer is addressed to an indefinite number of persons – individuals who are consumers in accordance with the Law of the Russian Federation “On Protection of Consumer Rights” of 07.02.1992 № 2300-121416.
1.3 The Seller – Limited Liability Company “Laboratory of Internal Beauty” (LLC “Laboratory of Internal Beauty”), registered at the address: 123290, Moscow, Shelepikhinskaya naberezhnaya, 42, building 3, apartment/office 418 (INN 7734497653, OGRN 1247700269376).
1.4 The Buyer is a natural person with legal capacity who has entered into a contract with the Seller on the terms and conditions of this Offer.
1.5.Online store – a hardware and software complex located at the address glutme.ru, providing identification of goods, their ordering and payment in the information and telecommunication network “Internet”.
1.6Acceptance of the Offer – full and unconditional acceptance by the Buyer of the terms and conditions of this Offer by performing the actions stipulated in paragraph 3 of Article 438 of the Civil Code of the Russian Federation: placing an order through the online store and its payment.
1.7. The contract shall be deemed concluded from the moment the Seller receives payment for the goods from the Buyer. The Seller has no right to unilaterally withdraw from the contract after acceptance of the Offer.
2. SUBJECT MATTER OF THE CONTRACT
2.1. The Seller undertakes to transfer the goods (cosmetic products) into the ownership of the Buyer, and the Buyer undertakes to accept the goods and pay its cost on the terms of this Offer.
2.2. Seller shall provide Buyer with complete product information, including:
name of the product, its purpose and field of application;
product composition;
manufacturer information;
date of manufacture and expiration date;
storage conditions;
method of application;
precautions for use;
the nominal volume or mass of the commodity;
the price of the product.
2.3. Seller warrants that the products sold are genuine, of proper quality and conform to the stated specifications.
3. PROCEDURE FOR EXECUTION AND ACCEPTANCE OF THE OFFER
3.1. To enter into a contract, Buyer:
studies information about the product on the website glutme.ru;
adds the selected item to the cart;
specifies personal data: Full name, contact phone number, e-mail address, delivery address;
chooses the method of delivery and payment;
confirms the order;
makes payment for the goods.
3.2. Placement of the order and its payment means the conclusion of the sales contract.
3.3 If a technical error is detected in the price of goods before payment, the Seller has the right to cancel the order by notifying the Buyer by e-mail within 24 hours.
3.4. After placing an order, the Buyer will receive a confirmation to the e-mail address specified by the Buyer.
4. PRICE OF GOODS AND PAYMENT PROCEDURE
4.1. The price of goods is specified in Russian rubles per unit of goods and includes VAT.
4.2. The price of the goods specified in the online store at the time of ordering is final. The seller has no right to change the price of the paid goods.
4.3. The total cost of the order includes the cost of goods and shipping (if paid).
4.4. Payment is made to:
by bank card via a secure connection (SSL protocol);
with electronic money;
cash on receipt (if available).
4.5. Title to the goods shall pass to the Buyer upon receipt.
5. DELIVERY OF GOODS
5.1. Delivery shall be made to the address specified by the Buyer. Methods of delivery:
courier service;
delivery points.
5.2. Delivery time depends on the selected method and region. Specific terms are specified when placing an order.
5.3 The risk of accidental damage to the goods passes to the Buyer from the moment of delivery of the goods by courier or receipt at the point of delivery.
5.4. Upon receipt, the Buyer is obliged to check the integrity of the packaging and conformity of the goods to the order. In case of discrepancy, a report shall be drawn up with a representative of the delivery service.
6. RETURN AND EXCHANGE OF GOODS
6.1. The buyer has the right to reject the goods:
before transfer – without explanation;
within 7 days after handover – for goods of proper quality.
6.2. Conditions of return of goods of proper quality:
the goods have not been used;
consumer properties are preserved;
The original packaging (including protective film, if applicable) has been retained;
there are documents confirming the purchase.
6.3 Goods with damaged packaging are not subject to return if it makes it impossible to sell them again according to sanitary and epidemiological requirements (clause 23 of the Resolution of the Government of the Russian Federation No. 612).
6.4 In case of return of goods of improper quality, the Seller shall refund the paid amount within 10 days from the date of receipt of the claim.
6.5 The costs of returning goods of proper quality shall be borne by the Buyer, those of improper quality – by the Seller.
7. PROCESSING OF PERSONAL DATA
7.1. The Buyer consents to the processing of personal data for the purposes of contract execution. Processing is carried out in accordance with Federal Law No. 152-FZ and the Privacy Policy (available at: glutme.ru/privacy-policy).
7.2. Seller agrees to:
not to transfer data to third parties without the Buyer’s consent;
provide protection against unauthorized access;
destroy data after the expiration of the retention period.
8. LIABILITY OF THE PARTIES
8.1. Seller is not responsible for:
damage caused by misuse of the goods;
temporary unavailability of the site due to maintenance;
actions of third parties that disrupt the operation of the site;
failures in the operation of payment systems and delivery services;
allergic reactions in the absence of prior testing;
the consequences of breach of storage conditions.
8.2. The buyer is responsible for the accuracy of the data provided.
8.3 The Parties shall be exempt from liability in case of force majeure circumstances.
9. DISPUTE RESOLUTION
9.1. All disputes are resolved through negotiation.
9.2. The claim procedure is mandatory. The term for consideration of the claim is 10 days from the date of receipt.
9.3 If the dispute cannot be settled, it shall be considered in court at the location of the Seller.
10. FINAL PROVISIONS
10.1. The offer is effective from the date of publication on the website and is valid until withdrawn.
10.2. Changes come into effect after the publication of the new edition. They do not apply to orders paid before the change.
